Dentist directed to pay Rs 40,000 as compensation in medical negligence

Jalandhar- The District Consumer Disputes Redressal Commission has directed a dental clinic and a dentist to pay an amount of Rs 40,0000 as compensation for medical negligence to a patient whose jaw bone got fractured during the surgery of wisdom tooth. The patient lodged a complaint against Clove Dental Clinic in Jalandhar and its maxillofacial surgeon.

The patient alleged and complaint that she developed severe pain in her wisdom tooth and hence took medical advice from the doctor. The doctor suggested her for the the X-ray for which she deposited Rs 3,000 in the hospital. The surgeon conducted the surgery and removed her wisdom tooth. But after the surgery her pain didn’t reduced and also got swelling and stiffness in the area. After she sent to the another when found no relief in her pain where she got to know about the injury in one of the nerve during surgery.

In a complaint she said that in all testing procedures she has spent about Rs 1,00,000 in consulation and follow-up.The court noted that the clinic and the hospitals did not produce and evidence in suptheir support.

On the basis keeping the facts and circumstance the hospital and the dentist were then directed to pay Rs 40,000 as compensation of medical harassment and physical harassment suffered by the complainant.
